Terms of Service

1. Definitions

• Platform: the Marrakech Maadine website and all associated services.
• User: any person accessing the Platform, whether registered or as a guest.
• Buyer: a User who purchases products through the Platform.
• Seller: a User who lists and sells products through the Platform.
• Admin: a Platform employee or authorised representative.
• Listing: a product or service offered for sale on the Platform.
• Order: a confirmed purchase transaction between a Buyer and a Seller facilitated by the Platform.

2. Eligibility

You must be at least 18 years of age to create an account or make a purchase. By using the Platform, you confirm that you meet this requirement. The Platform is open to users worldwide, though some features may be restricted based on your location.

Sellers must hold the legal right to sell the products they list, whether as the original creator, an authorised reseller, or a licensed trader under Moroccan commercial law.

3. Account Registration

To access full platform functionality, you must register an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Keep your login credentials confidential and not share them with third parties.
• Notify us immediately at support@maadine.ma if you suspect unauthorised access to your account.
• Be solely responsible for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.

4. Seller Accounts & Subscriptions

Sellers must apply for a seller account and be approved by the Platform. Approval is at our sole discretion and we may decline applications without providing a reason.

Seller accounts are offered under subscription plans ('Starter', 'Managed', 'Premium'). By subscribing:

• You authorise us to charge the subscription fee on the agreed billing cycle.
• Subscriptions renew automatically unless cancelled before the renewal date.
• No refunds are issued for partial subscription periods.
• We reserve the right to modify subscription pricing with 30 days' notice.

Sellers who do not renew their subscription will lose access to seller features; their listings will be suspended until the subscription is restored.

5. Listings & Prohibited Content

Sellers are responsible for the accuracy, legality, and completeness of their listings. You must not list:

• Counterfeit, fake, or misrepresented goods.
• Items that infringe third-party intellectual property rights.
• Prohibited or regulated items (weapons, controlled substances, live animals).
• Products that violate Moroccan law or international sanctions.
• Items not related to artisan craft (the Platform is dedicated exclusively to authentic handmade goods).

All listings are subject to admin review. We may remove any listing at our discretion without prior notice. Repeated violations will result in permanent account suspension.

6. Orders & Payments

When a Buyer places an order, a binding contract is formed between the Buyer and the Seller. The Platform acts as the intermediary facilitating the transaction.

• Prices are displayed in Moroccan Dirhams (MAD) unless otherwise indicated.
• Payment is processed at the time of order confirmation.
• The Platform charges a service fee on each transaction; the current fee structure is published in your seller dashboard.
• Orders may be cancelled within 24 hours of placement if the Seller has not yet shipped the item.
• Sellers are responsible for accurate shipping estimates and timely fulfilment.

7. Returns & Refunds

Buyers may request a return within 14 days of receiving an order if:

• The item received is significantly different from its description.
• The item arrives damaged or defective.
• The wrong item was shipped.

Custom-made or personalised items are non-refundable unless they arrive damaged or defective.

Return shipping costs are borne by the Seller when the return is due to Seller error, or by the Buyer in other cases. Refunds are processed within 7 business days of the Platform receiving confirmation of the return.

8. Intellectual Property

All content on the Platform — including the Marrakech Maadine name, logo, design, software, and editorial content — is the property of Marrakech Maadine and protected by Moroccan and international intellectual property law.

Sellers retain ownership of the content they upload (product photos, descriptions). By uploading content, you grant Marrakech Maadine a non-exclusive, royalty-free licence to display, reproduce, and promote that content for the purpose of operating and marketing the Platform.

You must not scrape, copy, or reproduce Platform content without our written permission.

9. Prohibited Conduct

You must not:

• Attempt to circumvent the Platform's payment system by transacting directly with other users.
• Post false reviews or manipulate the ratings system.
• Use the Platform to send spam, harass other users, or distribute malware.
• Attempt to hack, reverse-engineer, or disrupt the Platform's infrastructure.
• Create multiple accounts to evade a suspension or ban.
• Impersonate another user, seller, or Platform representative.

Violations may result in immediate account termination and may be referred to Moroccan law enforcement authorities.

10. Limitation of Liability

The Platform acts as an intermediary marketplace and does not manufacture, inspect, or guarantee the quality of products sold by Sellers. To the maximum extent permitted by applicable law:

• We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform.
• Our total liability in connection with any claim is limited to the amount you paid for the transaction giving rise to the claim.
• We make no warranty that the Platform will be available without interruption, error-free, or free from viruses.

Nothing in these Terms limits liability for fraud, death, or personal injury caused by our negligence.

11. Dispute Resolution

If a dispute arises between a Buyer and a Seller, both parties agree to first attempt resolution through the Platform's mediation process (accessible via the support centre).

If mediation fails, disputes will be submitted to the competent courts of Marrakech, Morocco, unless applicable consumer protection law requires otherwise.

For disputes between Users and the Platform itself, Moroccan law applies exclusively.

12. Termination

You may close your account at any time from your profile settings. We may suspend or terminate your account at any time for:

• Breach of these Terms.
• Fraudulent activity.
• Failure to pay outstanding amounts.
• Inactivity exceeding 24 months (with prior notice).

Upon termination, your access to seller or buyer features will cease immediately. Outstanding orders will be processed to completion. Data retention is governed by our Privacy Policy.

13. Amendments

We reserve the right to modify these Terms at any time. We will notify registered users by email and post a notice on the Platform at least 14 days before changes take effect. Continued use of the Platform after that date constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by the laws of the Kingdom of Morocco. Any dispute not resolved through mediation will be subject to the exclusive jurisdiction of the competent courts of Marrakech.
